Terms of Use

This website is owned and operated by DeltaHost, S.A., a Panama corporation. This document comprises the Terms of Use Agreement, (hereinafter referred to as the “Agreement”), and constitutes a legally binding Agreement between the visit and/or user of this site and DeltaHost, S.A.

As a condition precedent to the visitor and/or user being able to use any of the tools, functions, and information on this site, the visitor and/or user must read, understand and agree to be bound by each of the terms and conditions contained in this Agreement. However, by the mere act of accessing the functions and tools of this site, viewing any information, text or graphics herein, the visitor and/or user is deemed to have already read, understood, and agreed to be bound by this Agreement. I acknowledge that any personal assistance received from a nurse or other personnel is accepted at my own risk and that DELTAHOST, Costa Rica On Call Nurse.com, www.CostaRicaOnCallNurse.com, personnel are not responsible and will not be held responsible for any consequences whatsoever of any treatment received or not received including treatment resulting in injury, illness, accident or death. I understand that my doctor is the prime source for medical information and no conversations or written material acquired while receiving nursing services or services of any kind through DELTAHOST, Costa Rica On Call Nurse.com or www.CostaRicaOnCallNurse.com should be construed or relied on as medical advice.

HOLD HARMLESS

In consideration of accepting services of or from DELTAHOST, Costa Rica On Call Nurse.com, www.CostaRicaOnCallNurse.com, its owners, officers, directors, staff, employees, agents, volunteers, outside contractors, doctors, nurses or any other party involved in providing such services, for myself or for a member of my family if the member is under 18 years of age, I hereby agree to RELEASE, FOREVER DISCHARGE, INDEMNIFY AND HOLD HARMLESS Costa Rica On Call Nurse.com, www.CostaRicaOnCallNurse.com; Costa Rica On Call Nurse.com, www.CostaRicaOnCallNurse.com’s, parent company DeltaHost, S.A. a Panama Corporation, any entity or persons involved with the operation or providing of nursing services or any other type of service of, by or through DELTAHOST, Costa Rica On Call Nurse.com, www.CostaRicaOnCallNurse.com, its owners, officers, directors, staff, employees, agents, volunteers, outside contractors, doctors, nurses or any other party involved in providing such services, from any and all liability, claims, demands, damages, actions or causes of actions for loss, injury or damage to myself or my private property of any nature whatsoever which may be incurred by any persons contracting or accepting services provided by DELTAHOST, Costa Rica On Call Nurse.com, www.CostaRicaOnCallNurse.com, as a result of services provided or not provided or any activity associated with DELTAHOST, Costa Rica On Call Nurse.com, www.CostaRicaOnCallNurse.com, or any other reason whether caused by intentional or unintentional act, or NEGLIGENCE of any party. I hereby assume all risk of personal injury, sickness, death, damage and expense as a result of any services received or not received whether contracted or not as a result of association of any kind or circumstance with DELTAHOST, Costa Rica On Call Nurse.com, www.CostaRicaOnCallNurse.com.

PERSONAL BELONGINGS

Costa Rica On Call Nurse.com, www.CostaRicaOnCallNurse.com, DELTAHOST, DeltaHost, S.A., its owners, officers, directors, staff, employees, agents, volunteers, outside contractors, doctors, nurses, or any other party involved or not involved with providing any services, does not assume any liability for any loss of, or damage to, luggage, clothing, medicine, cash, credit or debit cards, passport, jewelry or similar valuables, securities, financial instruments, records or other valuable or business documents, computers, cellular telephones, cameras, hearing aids or other video or electronic equipment, film, videotape, computer disks, audio disks, tapes, CD¹s or any other personal items of any kind or nature.

Hotels typically provide safes of different types for such valuables and your use or non-use of either a hotel safe, in-room safe or any other method of safeguarding your valuables will not increase the liability of the Costa Rica On Call Nurse.com, www.CostaRicaOnCallNurse.com, DELTAHOST, DeltaHost, S.A., its owners, officers, directors, staff, employees, agents, volunteers, outside contractors, nurses, doctors or any other party involved or not involved with services. All valuables of any kind left attended or unattended whether in the presence or possession of Costa Rica On Call Nurse.com, www.CostaRicaOnCallNurse.com, DELTAHOST, DeltaHost, S.A., its owners, officers, directors, staff, employees, agents, volunteers, outside contractors, nurses, doctors or any other party involved or not involved with any services provided or not provided, are at your own risk and DELTAHOST, Costa Rica On Call Nurse.com, www.CostaRicaOnCallNurse.com assumes no responsibility or liability for theft or loss of your personal belongings in any way whatsoever and in no case shall the liability of Costa Rica On Call Nurse.com, www.CostaRicaOnCallNurse.com, DELTAHOST or DeltaHost, S.A., exceed Fifty Dollars (U.S.D.) for any loss or damage. The provisions of this paragraph as well as these entire Terms and Conditions a.k.a. Terms of Use of DELTAHOST, Costa Rica On Call Nurse.com, www.CostaRicaOnCallNurse.com is also binding on my heirs and representatives, estate, next of kin, and assigns. If I accept services of any type from DELTAHOST, Costa Rica On Call Nurse.com, www.CostaRicaOnCallNurse.com on behalf of a minor, I accept full responsibility, including all medical expenses incurred, as a result of the minor receiving such services or any loss of personal belongings. The minor shall be under the same terms as all other persons under these Terms and Conditions a.k.a. Terms of Use of DELTAHOST, Costa Rica On Call Nurse.com, www.CostaRicaOnCallNurse.com and I agree to HOLD HARMLESS AND INDEMNIFY the entities named above for any claims brought on behalf of the minor.

GENERAL

DELTAHOST, Costa Rica On Call Nurse.com, www.CostaRicaOnCallNurse.com, DeltaHost, S.A., does not guarantee to provide, perform, allow or participate or not participate in any services whatsoever and is not responsible for any non-provision, non-performance, non-participation, or loss or suspension of any services of any kind or type whatsoever whether advertised, not advertised, offered, accepted or under any other terms or conditions. DELTAHOST, Costa Rica On Call Nurse.com, www.CostaRicaOnCallNurse.com unilaterally reserves the right to terminate services of all kinds to any persons without notice for any reason or cause if, when in the sole opinion of DELTAHOST, Costa Rica On Call Nurse.com, www.CostaRicaOnCallNurse.com, its owners, officers, directors, staff, employees, agents, volunteers, outside contractors, nurses, doctors or any other party involved or not involved with services, any person shall become unruly, abusive, unstable, appears to be under the influence of drugs or alcohol, or perceived to be a danger to themselves, to Costa Rica On Call Nurse.com, www.CostaRicaOnCallNurse.com, DELTAHOST, DeltaHost, S.A., its owners, officers, directors, staff, employees, agents, volunteers, outside contractors, doctors, nurses, or any other party involved or not involved with providing any services. If this situation should apply to me, in such case, I agree to accept such termination by DELTAHOST, Costa Rica On Call Nurse.com, www.CostaRicaOnCallNurse.com, or DeltaHost, S.A., or by operation of law and agree that I will be entitled to no refund of monies owed or paid, and such monies will be forfeited to DELTAHOST, Costa Rica On Call Nurse.com, www.CostaRicaOnCallNurse.com, or DeltaHost, S.A., as appropriate, as liquidated damages.

I agree that any legal action that may arise from accepting or not accepting services of any kind or type from DELTAHOST, Costa Rica On Call Nurse.com, www.CostaRicaOnCallNurse.com, DeltaHost, S.A., whether under these terms and conditions or not, or any other terms or conditions that shall be established between the parties at any time whether oral, written or implied, shall be governed by and construed in accordance with the laws of the Republic of Panama, applicable to agreements made and entirely to be performed within the Republic of Panama, without resort to its conflict of law provisions. I agree that any action at law or in equity arising out of or relating to these terms and conditions shall be filed only in the jurisdiction of the Republic of Panama, and I hereby irrevocably and unconditionally consent and submit to the exclusive jurisdiction of such courts over any suit, action or proceeding arising out of these terms and conditions.

AGREEMENT

Nor shall DELTAHOST, Costa Rica On Call Nurse.com, www.CostaRicaOnCallNurse.com, DeltaHost, S.A., its owners, its officers, its directors, its staff, nurses, doctors, or any other party involved in providing any services be stopped from enforcing any provision of these terms and conditions. If any provision of these terms and conditions shall be deemed unlawful, void, or for any reason unenforceable, then that provision shall be deemed severable from these terms and conditions and shall not affect the validity and enforceability of any remaining provisions.

I have carefully read and understand the above as well as all of these Terms of Service a.k.a. Terms of Use, and agree to all terms and conditions and will fully abide by them, and further consent to personal and medical assistance as may be provided by DELTAHOST, Costa Rica On Call Nurse.com, www.CostaRicaOnCallNurse.com, DeltaHost, S.A., its owners, its officers, its directors, its staff, nurses, doctors or any other party involved in providing any services. In the event of a medical emergency, I hereby authorize DELTAHOST, Costa Rica On Call Nurse.com, www.CostaRicaOnCallNurse.com, DeltaHost, S.A., its owners, its officers, its directors, its staff, nurses, doctors or any other party involved in providing any services to summon a doctor or arrange transportation to a hospital or other medical facility and I agree to accept full responsibility for any and all costs associated with any treatment, transportation, hospital stay, or other services involved with such occurrences.

I HAVE CAREFULLY READ THESE TERMS OF SERVICE A.K.A. TERMS OF USE AND UNDERSTAND THAT IT IS A BINDING AGREEMENT AND FURTHER UNDERSTAND IT TO BE A RELEASE OF ALL CLAIMS AND CAUSES OF ACTION FOR MY INJURY OR DEATH OR DAMAGE TO MY PROPERTY OR LOSS OF ANY KIND THAT OCCURS WHILE ACCEPTING OR NOT ACCEPTING SERVICES OF ANY TYPE OR KIND OF OR FROM DELTAHOST, COSTA RICA ON CALL NURSE.COM, WWW.COSTARICAONCALLNURSE.COM, ITS OWNERS, OFFICERS, DIRECTORS, STAFF, EMPLOYEES, AGENTS, VOLUNTEERS, OUTSIDE CONTRACTORS, DOCTORS, NURSES OR ANY OTHER PARTY INVOLVED IN PROVIDING OR NOT PROVIDING SUCH SERVICES AND IT OBLIGATES ME TO INDEMNIFY ALL PARTIES NAMED ABOVE FOR ANY LIABILITY FOR INJURY OR DEATH OF ANY PERSON AND DAMAGE TO PROPERTY OR ANY LOSS CAUSED BY ANY NEGLIGENT, INTENTIONAL, UNINTENTIONAL ACT OR OMISSION.
